CF Management's Disclosure and Policy Regarding Biometric Identifiers or Information from or about ts Employees and Contractors


DISCLOSURE REGARDING Collection, Use, Retention, Disclosure and Destruction of BIOMETRIC IDENTIFIERS, BIOMETRIC INFORMATION AND OTHER INFORMATION ("DISCLOSURE")

CF Management-IL, LLC, CF Management-NY, LLC and CF Management-VA, LLC and their subsidiaries and affiliates and related entities, including but not limited to Capital Fitness, Inc., (collectively "CF Management") is or may be collecting, using, storing, destroying and disclosing either by itself or through vendors or third parties that perform services to or for any of CF Management involving or relating to biometric information or identifiers pursuant to agreements or otherwise (the "CF Vendors"), biometric identifiers and/or biometric information, from or about you.

The purpose of collecting, storing, using and disclosing what is or may be biometric identifiers or biometric information is for time keeping or payroll purposes and for other purposes regarding the operation and management of CF Management.

At the initial time, and potentially on subsequent or previous occasions, on which CF Management collects or collected what is or may be biometric identifiers or biometric information (e.g. encrypted fingerprint scan) from you, CF Management will or may store (including storage with CF Vendors) and use and disclose the biometric identifiers or biometric information for the purposes set forth above, during the time period you are an employee or contractor of CF Management and for a time period thereafter (i) until the purpose stated above has been entirely satisfied or (ii) contained within three years after the date of your last interaction with CF Management whichever of (i) or (ii) occurs first (the "Extended Time Period"). On or before the expiration of the Extended Time Period, CF Management shall permanently destroy or cause the permanent destruction of any biometric identifiers or biometric information stored by CF Management regarding you for purposes of your status as an employee or contractor of CF Management.

CF Management will not sell trade or disclose any biometric identifiers or biometric information it obtains from you to any other person or entity except as required by law and except for any of the CF Vendors.

POLICY of CF Management Regarding Retention and Destruction of Biometric Information Regarding its Employees and Contractors is as follows ("Policy"):

It is the policy of CF Management-IL, LLC, CF Management-NY, LLC and CF Management-VA, LLC and their subsidiaries, affiliates and related entities, including but not limited to Capital Fitness, Inc. (for purposes of this Policy, collectively "CF Management") to retain and destroy biometric information regarding its Employees and Contractors as follows: Biometric information or identifiers regarding Employees and Contractors of any of CF Managements in its possession may be retained or stored by CF Management during the time period the subject Employee or Contractor is an Employee or Contractor of any of CF Managements and for a time period thereafter until (i) the purposes for collection of the information (namely for time keeping or payroll purposes and for other purposes regarding the operation and management of CF Management) have been entirely satisfied or (ii) within three years after the date of the Employee/Contractors last interaction with any of CF Management, whichever of (i) or (ii) occurs.first (the "Extended Time Period"). On or before the expiration of the Extended Time Period for a particular Employee or Contractor, CF Management shall permanently destroy such individual :S· biometric identifiers and biometric information in its possession to the extent that such individual S biometric identifiers and biometric information are used for purposes that relate to such individuals relationship with CF Management only as an Employee or Contractor of CF Management. This Policy regarding Employees and Contractors shall not be applicable to the extent Employee or Contractors biometric identifiers and biometric information are used for purposes that relate to such individuals relationship with CF Management other than as an Employee or Contractor of CF Management (such as for example, as a member, client, customer or guest of Capital Fitness) at the time of expiration of the Extended Time Period CF Management may, in its sole discretion, change (including without limitation eliminate) this Policy, in whole or in part, at any time and time to time and without notice.
